A power of attorney or POA is a document that can be used to have someone else handle your property matters or financial matters in the event that you are unable to do so yourself. It is important to note that this kind of form is a legal form but holds no weight in court if a person in trial is incapacitated or is not able to make decisions on their own.

Who can I give authority to?

"principal", the person who creates the power of attorney can grant authority to another person who is usually called an 'authorized representative". The person given authority to does not have to be a lawyer and does not have to be registered or affiliated with the institution in which you want him/her to handle your affairs. He must be, however, of legal age and an adult. Since the principal is the one who made the document, and since this kind of document gives another person authority over your rights, the principal then has the authority to cancel or revoke the document at any time or he/she may put a specific time in which the document no longer hold any power.

If you are unsure about the specifics of a power of attorney then it is best to talk to a lawyer to ensure your safety and protection or call your local court house for additional information regarding your specific situation. Another important thing to take not is that different states may have different laws regarding POA's so it would also be best to contact a local court house for assistance on this. The last thing you want is to go through the hassle of having made the document and find out the hard way that it cannot be accepted simply because of a missed requirement or it does not pass state law.

Can I get pre-made forms?

Since a power of attorney is basically just a document, you don't really need to go to a certain office to get a form. A power of attorney online form can be acquired through the internet and can easily be changed to fit your specific needs.

Once you already have the form all you need to do is fill-up the necessary information, like name and address, name of representative, and other important details needed for verification purposes. After this, you can go to a notary public and have this document notarized to make it legal.
